These Terms & Conditions (“Terms”) govern your use of the Sharks Pools website and any services provided by Sharks Pools (“Company,” “we,” “our,” or “us”). By accessing this website, requesting an estimate, signing a proposal, or engaging our services, you agree to these Terms.
1. Services Provided
Sharks Pools specializes in the design and construction of vinyl liner swimming pools and related pool components. We do not build fiberglass or concrete (gunite) pools.
Services may include, but are not limited to:
- Vinyl pool construction
- Excavation and site preparation
- Pool equipment installation
- Plumbing and basic electrical coordination
- Pool startup and walkthrough
Specific services, pricing, and timelines are outlined in individual proposals or contracts.
2. Estimates & Proposals
- All estimates are non-binding until a written contract is signed.
- Pricing is based on information available at the time of the estimate.
- Site conditions discovered after excavation (rock, groundwater, unsuitable soil, utilities, etc.) may result in change orders and additional costs.
- Estimates are valid for a limited time and subject to material and labor availability.
3. Payment Terms
- Payment schedules are outlined in the signed contract.
- Deposits are required to secure scheduling and materials.
- Late or missed payments may result in work delays or suspension.
- All balances must be paid in full according to the contract terms.
Failure to make timely payments may result in additional fees or legal collection action.
4. Project Timeline & Delays
All project timelines provided by Sharks Pools are estimates only and are not guaranteed. Pool construction is a multi-phase process and may be impacted by conditions outside of our control.
Sharks Pools shall not be considered in breach of contract for delays caused by, including but not limited to:
- Weather conditions
- Permitting or inspection delays
- Material or equipment availability
- Subcontractor scheduling
- Site conditions such as rock, groundwater, soil instability, or utility conflicts
- Homeowner-requested changes or change orders
If work is delayed due to any of the factors listed above, Sharks Pools reserves the right to pause, reschedule, or extend the project timeline by up to twenty-one (21) days per occurrence, without penalty or obligation to provide compensation.
Extended delays beyond twenty-one (21) days may occur in certain circumstances and shall not constitute contract abandonment. Project timelines will resume once conditions allow work to proceed.
5. Permits & Inspections
- Permits may be required depending on local regulations.
- Responsibility for permits will be specified in the contract.
- Homeowners are responsible for HOA approvals, property line verification, and easements unless otherwise stated.
6. Site Access & Responsibilities
The homeowner agrees to:
- Provide clear access to the job site
- Mark or disclose underground utilities, sprinklers, septic systems, or private lines
- Remove pets, furniture, and personal items from work areas
- Accept reasonable site disturbance (heavy equipment, soil displacement, noise)
Sharks Pools is not responsible for damage to undisclosed or unmarked underground items.
7. Change Orders
Any changes to the original scope of work must be documented in a written change order and may affect:
- Final cost
- Project timeline
- Material availability
Work outside the original contract will not be performed without approval.
8. Warranty & Limitations
- Warranty coverage varies by component and manufacturer.
- Vinyl liners, pumps, heaters, and other equipment are subject to manufacturer warranties.
- Workmanship warranties (if provided) are outlined in the contract.
Warranty does not cover:
- Normal wear and tear
- Chemical imbalance or improper maintenance
- Ground movement or settling
- Acts of nature (flooding, freezing, storms)
- Damage caused by third parties
9. Maintenance & Pool Care
After completion, the homeowner is responsible for:
- Proper water chemistry
- Routine maintenance
- Winterization and seasonal care
Improper maintenance may void warranties.
10. Safety & Liability
Swimming pools involve inherent risks. By using the pool, the homeowner agrees to:
- Follow all safety guidelines
- Supervise swimmers
- Install required fencing, covers, or safety devices per code
Sharks Pools is not responsible for injuries, accidents, or misuse of the pool after project completion.
11. Cancellations & Termination
- Cancellation terms are defined in the signed contract.
- Deposits may be non-refundable once materials are ordered or work has begun.
- Sharks Pools reserves the right to terminate services for non-payment, unsafe conditions, or contract violations.
12. Website Use
By using this website, you agree not to:
- Misuse forms or contact tools
- Attempt unauthorized access
- Copy or distribute site content without permission
All content is the property of Sharks Pools unless otherwise stated.
13. Limitation of Liability
To the fullest extent permitted by law, Sharks Pools shall not be liable for:
- Indirect or consequential damages
- Loss of use or enjoyment
- Delays or cost overruns due to external factors
Liability is limited to the amount paid under the contract.
14. Governing Law
These Terms are governed by the laws of the state in which Sharks Pools operates, without regard to conflict of law principles.
15. Changes to Terms
Sharks Pools may update these Terms at any time. Continued use of the website or services constitutes acceptance of the updated Terms.
